1. Provider and scope
Hanivo is a Chinese-language learning application and related website operated by operated by Williams Caballero - CABALLERO WORKS, Software & Digital Products, a sole proprietorship based in Graz, Austria. Full legal contact details are available in our Impressum.
These Terms govern access to Hanivo's learning application, website account services, free features, and premium digital products. Additional terms specifically disclosed before a purchase may apply. Mandatory consumer rights always take precedence over conflicting provisions.
2. Agreement to these Terms
You may use supported free guest-learning functions without creating an account. Creating an account requires reviewing and expressly accepting the current applicable Terms. Hanivo records the accepted document version and time of acceptance.
The Privacy Policy explains personal-data processing; agreement to these Terms does not amount to blanket consent to optional processing. When we make a material contractual change that requires fresh agreement, we will request it through an appropriate process. Merely continuing to use Hanivo does not automatically establish acceptance of all future contractual changes.
3. Eligibility and minors
Hanivo's supported free guest-learning tools are intended to be accessible to learners of different ages. For the initial release, account registration is available only to users 14 years of age or older, subject to stricter applicable local requirements. Children under 14 may use supported guest features but may not create an account in this release.
Users under 18 must have any parent or guardian involvement required by applicable law for purchases or other binding commitments. Being permitted to register does not, by itself, establish legal capacity to make every purchase.
4. Guest mode, registration and account security
Guest progress is primarily stored locally on the device. It is not automatically protected by a cloud account and may be lost if local application data is deleted, the app is uninstalled, or the device is lost or reset.
Registered accounts use email-based authentication and may synchronize supported learning progress across devices. You must provide accurate registration information, protect your credentials, and notify us at support@hanivo.app if you suspect unauthorized account activity. Accounts are personal and must not be sold or transferred without our authorization.
5. Free and premium learning features
Hanivo provides free learning tools, including the supported HSK 1 starter offering. Additional HSK levels, mock-exam packs, Dictionary Pro and other functionality may be available through individual purchases or Hanivo All Access subscriptions. The precise contents, compatibility, price and access terms of a product are those shown in its purchase description at checkout.
Practice examinations and other educational materials are for learning and preparation. Hanivo is not an official HSK examination authority and does not issue official HSK qualifications unless expressly identified otherwise.
6. License to use Hanivo
Subject to these Terms and the applicable purchase rights, we grant you a limited, personal, non-exclusive, non-transferable license to use Hanivo and access licensed learning material for lawful personal educational purposes. This does not transfer copyright or ownership of software, content, trademarks or other intellectual property.
You may use supported downloaded content offline while entitled to it. You must not unlawfully redistribute premium content, bypass access controls, interfere with service security, or commercially exploit the service without permission. These restrictions do not limit statutory exceptions, interoperability rights, or rights under applicable third-party open-source licenses.
7. Intellectual property and educational material
Hanivo's original software, design, branding and original educational content are protected by applicable intellectual-property laws. Some vocabulary or dictionary materials may originate from third-party or openly licensed sources; their applicable licenses remain respected. Corrections and content updates may be made to improve quality, accuracy, security and compatibility, subject to legal obligations to customers.
8. Individual premium purchases
Hanivo may sell specific HSK learning packages, mock-exam packs and Dictionary Pro editions through one-time purchases. A one-time purchase grants ongoing access to the identified product under the purchase terms, without requiring a recurring subscription. It is not ownership of the software or a promise that every future, separately marketed product or major edition will be included free.
Individually purchased products remain independently accessible when a separate All Access subscription is cancelled or expires, subject to the original purchase terms, technical requirements and mandatory consumer rights. If a product advertises unlimited mock-exam retakes, this applies to the purchased exam pack as offered.
9. Hanivo All Access subscriptions
Hanivo may offer monthly and annual All Access plans. The precise features included in a subscription are shown before purchase. Access to subscription-only features is provided for the active subscription period; separately purchased content is not converted into subscription-only content.
Where a plan automatically renews, this will be disclosed clearly before the order, together with its billing frequency, total recurring charge, renewal conditions and cancellation instructions. Customers can cancel future renewals through the subscription management method made available for their payment channel. Cancellation ordinarily preserves already-paid access until the current paid period expires, unless applicable law, a refund or another agreement requires otherwise.
Changes to recurring prices or other material subscription conditions will be handled only with legally required notices and permissions; new advertised prices do not automatically change an existing customer's contract.
10. Prices, payments and billing
The price, currency, applicable taxes, additional charges, billing frequency and essential product information will be clearly displayed before purchase.
For purchases made through Hanivo’s website, we plan to use Stripe as the payment processor. The payment methods available to a customer are stated during checkout. Access to paid content is activated after payment verification. We do not collect full payment card numbers or card security codes through Hanivo’s own servers.
If Apple In-App Purchase or Google Play Billing is offered in the future, the applicable purchase and subscription terms will be disclosed for those channels.
11. Withdrawal rights, refunds and digital-content conformity
Consumers have any statutory withdrawal, warranty, conformity, refund and other remedies available under applicable law. The legally required withdrawal notice, procedures and model withdrawal form, where applicable, will be made available before a purchase.
For digital content not supplied on a physical medium, any loss of a statutory withdrawal right after immediate delivery depends on satisfaction of the applicable legal requirements, which may include prior express consent to immediate performance, acknowledgment of the resulting loss of withdrawal rights and required confirmation. A general acceptance of these Terms is not a substitute for those purchase-specific steps.
Ongoing digital services and subscriptions may be subject to different withdrawal rules. Nothing in this section excludes mandatory rights relating to defective, nonconforming or undelivered digital content or services. Refund requests and questions may be sent to support@hanivo.app; payment-provider procedures may also apply.
12. Learning progress and synchronization
Hanivo stores guest learning data primarily on the device. Registered users can synchronize supported vocabulary learning progress, mock-exam history and other supported account information through Hanivo's cloud infrastructure. Not every device setting or local record necessarily synchronizes.
Users should maintain access to their accounts and keep supported applications up to date. We use reasonable safeguards and recovery mechanisms but cannot promise that all data on a lost, damaged or permanently offline device can be recovered. Mandatory legal rights remain unaffected.
13. Account deletion and termination
Registered users may request permanent account deletion through Settings → Account → Delete account, subject to identity verification and the confirmation process. Account deletion is intended to remove the account, associated cloud learning progress, exam history, account-local records and premium entitlements. Separately stored Guest progress and shared installed packages are not targeted. Limited deletion records and legally required financial records may be retained as described in the Privacy Policy.
Account deletion is distinct from subscription cancellation. Users with an active subscription must follow the applicable cancellation process; deleting the account alone does not automatically establish that recurring billing has stopped. Information about how to cancel is provided through the subscription management process.
We may restrict access where reasonably necessary for material misuse, fraud or security threats, with proportionate treatment and respect for statutory and purchased-content rights.
14. Availability, software updates and product changes
Hanivo may update the app, content packages and supporting services to fix bugs, maintain security, ensure compatibility and improve learning features. Some updates may be necessary for continued secure service operation. Where changes to ongoing digital products or services affect customers' rights, we will follow applicable requirements on notice, conformity, continued access and remedies.
We may introduce separately priced new products or editions. Their inclusion in an existing purchase or subscription depends on what was expressly offered. We will not rely on an unrestricted right to remove purchased content without regard to consumer protections.
15. Educational accuracy and results
We seek to provide accurate Chinese characters, pronunciation, translations, examples and examination practice. Educational content can contain errors and may be corrected. Individual learning progress and HSK examination outcomes vary; Hanivo does not promise a particular learning result or an official examination pass.
16. Permitted conduct and external links
You agree not to misuse Hanivo, gain unauthorized access, compromise accounts, conduct unlawful automated extraction, or infringe third-party rights. Links to third-party websites or services may be provided for convenience. Those providers are responsible for their own services and data-processing information, subject to applicable law.
17. Privacy
Personal-data processing is described in the Hanivo Privacy Policy. The Privacy Policy is a separate transparency document. Requests involving privacy and personal data may be sent to support@hanivo.app.
18. Liability and mandatory rights
Hanivo's liability is determined by applicable Austrian law and mandatory consumer-protection rules. Nothing in these Terms excludes or limits liability for intent, gross negligence, personal injury or other matters where a restriction is prohibited, or limits mandatory rights relating to the conformity and supply of digital content and services.
19. Governing law and dispute resolution
Austrian law applies to the extent permitted. Consumers retain mandatory protections of their habitual country of residence where applicable; mandatory jurisdiction rules remain unaffected.
Please contact support@hanivo.app to seek a resolution. Information on applicable consumer alternative dispute-resolution procedures will be provided where legally required.
20. Document versions, severability and contact
The currently published Terms show their version and effective date. Previously accepted Terms versions are retained for contractual and verification purposes. If a provision is unenforceable, the remaining provisions continue only to the extent permitted by applicable law.
